Stations Again Urged to Exercise Caution with Attack Ads
posted on 10.29.2024- Last Minute Buys in Final Days of Election Risky
The final days of a General Election when the White House is up for grabs often bring last minute third-party ads attacking a candidate and Texas stations fortunate enough to get those buys should be especially careful to assess the content of such ads from non-candidate groups, says attorney David Oxenford with Wilkinson Barker Knauer.
For anyone who thinks that broadcasters cannot censor such ads and are immune from any liability for their content, that’s actually the case only for ads purchased by candidates, not third parties.
TAB published Oxenford’s October 10 blog post on this issue as a newsletter brief two weeks ago, and we’re elevating it in this week’s issue of the TABulletin to ensure stations are aware of the care they need to take to ensure they stay out of costly legal trouble in the waning days of the 2024 election.
