KBXD-AM Dallas fined $9,000 for EAS violations
posted on 2.24.2014The FCC has fined JCE Licenses, LLC, licensee of KBXD-AM Dallas, $9,000 for “failing to maintain operational Emergency Alert System (EAS) equipment and logs.”
On Jan. 17, 2013, an agent from the Dallas FCC field office, accompanied by KBXD’s general manager, inspected the station’s main studio in Dallas and observed, when the station was in operation, that it had no installed EAS equipment.
FCC documents say the KBXD’s general manager “admitted that the station had been without operational EAS equipment since the station returned to the air in late November 2012.
The station also did not have any EAS logs, documenting when the last EAS tests were transmitted or received.”
The base forfeiture amount for failing to have operational EAS equipment is $8,000.
The FCC also said “JCE’s failure to maintain any EAS logs warrants an upward adjustment of $1,000” bringing the total fine to $9,000.
The station must also provide a written statement to the FCC, within 30 days of the date of the Notice of Apparent Liability, that the station is in full compliance with the commission’s EAS requirements.
