CBD Advertisements-Current Law and Best Practices

Signed into law on June 10, 2019, Texas House Bill 1325 legalized the production, manufacture and sale of hemp and hemp-derived products in Texas.
This includes consumable goods containing canabidiol—popularly known as “CBD.”
The prospect of legal CBD sales naturally raises the prospect of CBD advertising. And the prospect of CBD advertising in turn raises questions regarding what broadcasters can and cannot put on air, particularly given the longstanding association between hemp and illegal drugs.
